Welcome to Matty England Website Services Terms and Conditions! These terms and conditions (“Terms”) govern your use of website design, SEO, and management services offered by mattyengland.com (referred to as “the Company,” “Matty,” “Matty England,” “we,” or “us”). By accessing or using my services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using my services.

1. Services and Payment Agreements

1.1. Web Design Services
Matty England Website Services provides bespoke website design services tailored to help clients build their online presence. A 50/50 payment structure applies: 50% is due as a deposit upon agreement, and the remaining 50% is payable upon project completion.

1.2. Scope Changes and Additional Work
If the scope or scale of the project changes during development, the final 50% of the original agreement becomes immediately payable. Additional work beyond the initial scope will be quoted and invoiced separately.

1.3. SEO, Social Media Marketing, and Website Management Plans
These services are offered on a pre-paid monthly retainer basis. Terms and pricing will be set out in a separate proposal or agreement.

1.4. Hourly Rate
Hourly services are billed at £45 per hour, and this option is only available for small tasks under 5 hours. Larger projects will default to the 50/50 payment split model.

1.5. SEO Proposals and Consultations
Initial SEO proposals requiring up to 1 hour are complimentary. Additional research, auditing, or consultation is chargeable at the standard hourly rate of £45. This policy protects against misuse of my time and expertise under the guise of free proposals.

1.6. SEO and Website Management
All SEO and website management services are billed monthly in advance under a retainer model.

By entering a retainer agreement, you benefit from reduced hourly rates and priority scheduling and Matty England Website Services benefits from regular and predictable income. This is the nature of a retainer based service. 

As part of our working relationship, I commit to delivering my side of the agreement in line with the targets, timelines, and performance goals we agree upon at the outset. In return, the client must also commit to upholding their side – ensuring that communication, resources, and decisions are provided on time and that the overall direction of the campaign remains consistent. This mutual accountability is essential to achieving meaningful results.

Due to this discounted structure and focus on targets, in the event of client-side delays, monthly invoices will continue as scheduled. This includes (but is not limited to) delays caused by failure to provide access credentials, content, approvals, or responses necessary to proceed.

Furthermore, I reserve the right to pause or terminate any SEO, website management, or digital marketing arrangement if the client is actively obstructing (even if unintentionally) progress or preventing results. This includes:

  • Failure to supply essential resources, content, or data.

  • Repeated missed deadlines or non-communication.

  • Sudden and significant changes to strategy, such as keyword targets, product ranges, or overall business direction.

  • Micromanagement, conflicting instructions, or repeated reversals of previous decisions that hinder progress.

In these cases, I may pause or fully terminate the project at my sole discretion. No refunds or credit for unused time will be provided in these circumstances.

This policy exists to protect service quality, maintain fair scheduling for all clients, and prevent misuse of my availability or expertise.

1.7. Self-Managed Websites
Clients who manage their own websites hosted on my servers will notice certain admin permissions (such as plugin installation) are restricted to prevent errors or security risks. If you require plugin installations, please submit a request via your support channel. I will happily install and configure plugins after reviewing their compatibility.

1.8 Unmanaged Websites & Emergency Support
Clients who manage their own websites without a management plan do so entirely at their own risk. I do not accept responsibility for website issues, downtime, or errors on unmanaged websites. Any repair requests for unmanaged websites are considered ad-hoc emergency work and are charged at an emergency hourly rate of £145 per hour, payable in advance. This service is only available Monday to Friday, 9:00am – 5:00pm, and subject to availability.

24/7 priority support is exclusively available to clients on an active website management plan.

2. Refunds and Termination

2.1. Digital Nature of Work
Refunds or partial refunds are not available for any services delivered due to the non-tangible, non-returnable nature of digital work. This is standard practice in the industries of SEO, website design, and digital marketing.

2.2. Client Withdrawal from Projects
Should you choose to withdraw from a project prior to completion, any payments made will be forfeited and any partially completed work will not be supplied. This is standard industry practice.

2.3. Switching Providers
Clients are free to move their website or SEO services elsewhere. However, any outstanding invoices must be settled in full before domain transfers, handovers, or migration assistance can be provided.

3. Intellectual Property

3.1. Ownership Upon Completion
Upon full payment, you will own the final website design, content, and graphics created specifically for your project. I retain the right to display completed work in my portfolio or marketing materials unless agreed otherwise in writing.

3.2. Third-Party Content
You are responsible for ensuring you have full legal rights to use any third-party content (e.g., logos, images, text) supplied for your website. I accept no liability for copyright infringement arising from client-provided materials.

4. Confidentiality

4.1. Information Security
I take confidentiality seriously and will take reasonable steps to protect sensitive client data. However, due to the nature of digital environments, absolute confidentiality cannot be guaranteed. By using my services, you acknowledge and accept this limitation.

5. Limitation of Liability

5.1. No Indirect Liability
I am not liable for any direct or indirect losses, including financial loss, lost data, or loss of business, arising from the use of my services.

6. Termination of Services

6.1. Client-Initiated Termination
You may terminate your service at any time with written notice. No refunds will be issued for services already rendered or retainers already paid.

6.2. My Right to Terminate
I reserve the right to suspend or terminate your access to services without prior notice if I believe you have violated these Terms or your behaviour jeopardises the quality of work, the relationship, or my business reputation.

7. Governing Law

7.1. Legal Jurisdiction
These Terms are governed by UK law. Any disputes shall be resolved exclusively in UK courts.

8. Amendments to Terms

8.1. Right to Update
I may modify or update these Terms at any time. Changes will be posted on my website and become effective immediately. Continued use of my services signifies acceptance of any changes.

9. Entire Agreement

9.1. Final Agreement
These Terms, along with any written proposals or contracts, form the full agreement between you and Matty England Website Services and override any previous informal agreements.
